Welcome to GiftThatNow.
These Terms of Service ("Terms") govern your access to and use of GiftThatNow.com (the "Site") and any products or services offered through the Site.
Throughout these Terms, "GiftThatNow," "we," "us," and "our" refer to GiftThatNow and the business operating this Site. "You" and "your" refer to any visitor, customer, or person using the Site.
By accessing our Site and/or purchasing a product from us, you agree to be bound by these Terms, together with our Privacy Policy, Shipping & Delivery Policy, and Refund, Return & Cancellation Policy.
If you do not agree with these Terms, please do not use the Site or place an order.
1. ONLINE STORE TERMS
By using this Site, you represent that you are legally capable of entering into a binding agreement in your jurisdiction or have the permission of a parent or legal guardian where required.
You may not use our products, Site, or services for any unlawful or unauthorized purpose. You must not transmit viruses, malicious code, or any other material intended to interfere with the operation or security of the Site.
We reserve the right to refuse service, cancel orders, or restrict access where reasonably necessary to prevent fraud, abuse, unlawful activity, or violations of these Terms.
2. PRODUCTS & PRODUCT INFORMATION
We make reasonable efforts to display and describe our products accurately.
However, product colours and appearance may vary slightly depending on your device, screen settings, photography, manufacturing batches, suppliers, or reasonable production variations. Product packaging may also differ from images displayed on the Site.
Minor differences that do not materially affect the product's intended function do not automatically constitute a defective or incorrect product.
We reserve the right to modify product descriptions, specifications, availability, pricing, and other information where appropriate.
3. PRODUCT AVAILABILITY
All products are subject to availability.
A product appearing on our Site does not guarantee that it will remain available at the time your order is processed.
If a product becomes unavailable after an order has been placed, we may contact you regarding an appropriate alternative, replacement, cancellation, or refund. We will not intentionally substitute a materially different product without informing you.
4. THIRD-PARTY FULFILLMENT
GiftThatNow works with third-party suppliers, warehouses, fulfillment facilities, logistics providers, and shipping carriers to process and deliver orders.
Products may be stored, packaged, and shipped directly by our fulfillment partners.
Depending on product availability and your delivery location, products may ship from domestic or international fulfillment locations, products from the same order may arrive separately, different packages may have different tracking numbers, delivery dates may vary between packages, and packaging may differ depending on the applicable fulfillment facility.
GiftThatNow remains your customer-service point of contact for purchases made through GiftThatNow.com.
5. ORDERS
By placing an order, you confirm that all information you provide is complete and accurate.
We reserve the right to accept, reject, hold, or cancel an order where reasonably necessary, including where a product is unavailable, payment cannot be verified, an order is identified as potentially fraudulent, pricing or product information contains a material error, we cannot fulfill the order, the order appears to involve unauthorized activity, or the transaction violates these Terms or applicable law.
Receiving an order confirmation does not necessarily mean that an order has been finally accepted or shipped.
6. ORDER CANCELLATIONS
Orders may only be cancelled within 12 hours of being placed.
After the 12-hour cancellation period has passed, your order may have entered processing or fulfillment and cancellation cannot be guaranteed or accepted once processing has progressed beyond the point where it can reasonably be stopped.
If you wish to cancel an order, contact our customer support team as soon as possible. A cancellation request is not considered approved until you receive confirmation from us.

7. ORDER CHANGES
Requests to change your shipping address, contact information, product, variant, size, colour, or quantity must be submitted within 12 hours of placing your order.
Once fulfillment has begun, changes may no longer be possible. Customers are responsible for reviewing all order details before completing checkout.
8. PRICES
Prices displayed on GiftThatNow.com are subject to change without notice.
The price charged for a product will generally be the price displayed at checkout when the order is placed, except in cases involving obvious pricing errors or other circumstances where applicable law permits correction.
Discounts, promotional codes, and special offers may be subject to separate conditions and expiration dates. Unless specifically stated otherwise, promotional offers cannot necessarily be combined.
9. PAYMENTS
Customers agree to provide current, complete, and accurate payment and billing information.
Payments may be processed through Shopify and/or third-party payment providers. By submitting payment information, you represent that you are authorized to use the applicable payment method.
We reserve the right to cancel, hold, or review transactions that are declined, unauthorized, incomplete, or identified as potentially fraudulent.
10. TAXES, DUTIES & CUSTOMS
Applicable taxes may be calculated or collected during checkout depending on the customer's location and applicable requirements.
For international shipments, customs duties, import taxes, handling charges, or other government-imposed fees may apply.
Unless otherwise stated at checkout or required by applicable law, customers may be responsible for applicable import duties, taxes, or customs charges imposed by the destination country.
GiftThatNow does not control customs authorities or their processing times.
11. SHIPPING & DELIVERY
Our estimated delivery timeframe is generally 10–20 days from the date the order is placed.
This timeframe includes normal processing, fulfillment, and shipping. Delivery dates are estimates rather than guaranteed dates.
Delivery may occasionally take longer due to circumstances including carrier delays, customs processing, weather, transportation disruptions, holidays, high shipping volumes, local postal delays, remote delivery destinations, or circumstances outside our reasonable control.

12. SHIPPING INFORMATION
Customers are responsible for providing accurate and complete shipping and contact information, including the recipient's full name, street address, apartment/unit number where applicable, city, state/province, postal/ZIP code, country, phone number, and other information reasonably required for delivery.
GiftThatNow generally cannot provide a free replacement or refund when delivery fails because the customer supplied incorrect or incomplete information, except where required by applicable law.
13. TRACKING
Where tracking is available, tracking information will be provided after an order has been processed and dispatched.
Tracking systems may take time to update. Temporary delays or gaps in tracking information do not automatically mean that a package is lost.
If tracking information is invalid or cannot reasonably be used to verify the shipment, contact our customer support team so that we can investigate.
14. FAILED, REFUSED & UNCLAIMED DELIVERIES
Customers are responsible for monitoring tracking information and cooperating with the local carrier where reasonably necessary.
GiftThatNow generally cannot provide a free replacement or refund where delivery fails because the customer provided incorrect delivery information, the carrier cannot contact the recipient, the recipient fails to collect the package, reasonable delivery attempts are unsuccessful due to circumstances attributable to the customer, or the recipient refuses the package.
Refusing delivery does not automatically constitute an approved return or cancellation.
15. RETURNS, REFUNDS & REPLACEMENTS
Refunds, replacements, returns, and damaged-item claims are governed by our Refund, Return & Cancellation Policy.
Damaged or broken products must generally be reported within 9 days of receipt, together with the evidence reasonably requested in that policy.
Change-of-mind returns are generally not accepted, except where applicable consumer law requires otherwise.
Customers should not return a product without first contacting GiftThatNow and receiving applicable return instructions.
16. LOST ORDERS
An order will not automatically be considered lost merely because it takes longer than the estimated delivery timeframe.
If tracking shows that the shipment remains actively in transit, additional delivery time may be required.
Where a shipment cannot reasonably be located and is confirmed as lost following investigation, we may provide a replacement, refund, or another appropriate resolution in accordance with our Refund, Return & Cancellation Policy.
17. PACKAGES MARKED AS DELIVERED
Where carrier tracking confirms that a package has been delivered, the shipment will generally be considered completed.
Customers who cannot locate a package marked as delivered should first check the delivery location, household members, neighbours, reception/mailroom where applicable, and contact the local carrier.
A customer reporting a package as missing after tracking confirms delivery does not automatically qualify the order for a refund or replacement. We may investigate the circumstances and available delivery information before determining an appropriate resolution.
18. PROMOTIONS & DISCOUNT CODES
GiftThatNow may periodically offer discounts, promotions, promotional codes, bundles, or other special offers.
Unless otherwise stated, promotions may be modified or discontinued, promotional codes may have expiration dates, codes may apply only to eligible products, only one promotional code may be permitted per order, and promotional offers cannot necessarily be applied retroactively to previously placed orders.
We reserve the right to cancel or reject promotions used fraudulently, improperly, or contrary to the stated promotional conditions.
19. ACCURACY OF INFORMATION
We make reasonable efforts to ensure that information on our Site is accurate.
However, the Site may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, availability, shipping information, or other content.
We reserve the right to correct errors and update information where appropriate. If a material error affects an order already placed, we will handle the matter in accordance with applicable law.
20. INTELLECTUAL PROPERTY
Unless otherwise stated, content appearing on GiftThatNow.com, including text, branding, graphics, logos, website design, photographs, videos, and other materials owned by or licensed to GiftThatNow is protected by applicable intellectual property laws.
You may not reproduce, distribute, commercially exploit, modify, or republish our protected content without appropriate authorization.
Nothing in these Terms grants you ownership of GiftThatNow intellectual property.
21. CUSTOMER REVIEWS & USER CONTENT
If you submit a review, photograph, comment, testimonial, or other content to GiftThatNow, you represent that you have the right to provide that content.
You must not submit content that is fraudulent, unlawful, defamatory, abusive, infringing, misleading, or otherwise violates the rights of another person.
Where permitted by applicable law and subject to any permissions or platform terms applicable to the submission, we may use content you voluntarily submit in connection with operating, promoting, or improving our business.
22. PROHIBITED USES
You may not use the Site for unlawful purposes, to violate applicable laws or regulations, to infringe intellectual property rights, to submit false or misleading information, to distribute malicious software, to interfere with Site security, to collect information about others unlawfully, to engage in fraudulent transactions, to abuse promotional offers, or to interfere with the normal operation of GiftThatNow.com.
We reserve the right to restrict access or cancel transactions where we reasonably believe these Terms have been violated.
23. THIRD-PARTY SERVICES
Our Site may use or provide access to services operated by third parties, including payment processors, shipping carriers, analytics providers, advertising platforms, social media platforms, and other service providers.
Third-party services may be governed by their own terms and privacy practices.
GiftThatNow is not responsible for independent third-party websites or services except to the extent responsibility cannot legally be excluded.

Our collection and processing of personal information is described in our Privacy Policy.
By using GiftThatNow.com, you acknowledge that information may be processed as described in that policy.
Information reasonably necessary to fulfill an order may be provided to suppliers, fulfillment facilities, logistics providers, payment processors, shipping carriers, and other service providers involved in completing the transaction.
25. FRAUD PREVENTION
We reserve the right to review transactions for potential fraud, unauthorized payment activity, policy abuse, or other suspicious activity.
We may request additional information reasonably necessary to verify an order. Where permitted by applicable law, suspicious orders may be held, cancelled, or refunded.
26. CHARGEBACKS & PAYMENT DISPUTES
If you experience an issue with an order, we encourage you to contact GiftThatNow customer support first so that we have an opportunity to investigate and resolve the issue.
We maintain transaction, payment, fulfillment, tracking, delivery, and customer-service records and may provide relevant information to payment processors, card issuers, banks, or other authorized parties when responding to a payment dispute.
Nothing in these Terms limits rights that cannot legally be waived, including applicable rights customers may have through their payment provider or consumer protection laws.
27. DISCLAIMER OF WARRANTIES
To the maximum extent permitted by applicable law, GiftThatNow does not guarantee that the Site will always operate uninterrupted, error-free, or without technical issues.
Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot legally be excluded.
28. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, GiftThatNow will not be liable for indirect, incidental, special, or consequential losses arising from use of the Site or products where such liability may lawfully be limited or excluded.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
29. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold GiftThatNow harmless from claims, losses, liabilities, or reasonable expenses resulting from your unlawful use of the Site, violation of these Terms, or infringement of third-party rights.
30. SEVERABILITY
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be interpreted or limited to the extent necessary under applicable law.
The remaining provisions will continue in effect.
31. TERMINATION
We may restrict or terminate access to the Site where reasonably necessary because of fraud, unlawful conduct, misuse of the Site, or material violation of these Terms.
Any obligations arising from purchases completed before termination will continue where applicable.
32. CHANGES TO THESE TERMS
We may update these Terms periodically to reflect changes to our services, business practices, legal requirements, or policies.
The latest version will be published on GiftThatNow.com with an updated "Last Updated" date. Changes will apply as permitted by applicable law.
33. GOVERNING LAW
These Terms and transactions through GiftThatNow.com will be governed by the laws applicable to the business entity operating GiftThatNow, subject to mandatory consumer protection rights that may apply based on the customer's jurisdiction.
Before publishing this section, GiftThatNow should insert the applicable governing jurisdiction based on the legal entity that owns and operates the store.
34. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Shipping & Delivery Policy, Refund, Return & Cancellation Policy, and any additional terms displayed during checkout or in connection with a particular promotion constitute the applicable terms governing your use of GiftThatNow.com and purchases made through the Site.

Customers contacting us regarding an existing order should include their order number and the email address used to place the order.
Where legally required, GiftThatNow will also publish the legal business name, business address, telephone number, and other required merchant information.
